Brief
notes:
Replication
of Richard Sympson & Edward Peryam, complt. to the answer of Thomas
Preswicke and Elizabeth his wife deft (not dated).
- Richard Dynes left an estate of £5000
- Estate came into the hands of Thomas Sympson & Robt Atkinson
-
mention of a suit in this court by deft Preswicke & his wife
against Sympson & Atkinson by which Preswicke appears to have gained
a portion of the estate in the right of his wife as executrix to the
said Thomas Sympson
- reference to legacies to 2 children of
Thomas Sympson, which the complts believe should be levied out of the
estate of Thomas Sympson, which they deny to be of so small a
proportion as £150
- Complts say that Preswicke has received at least £1600 from Atkinson by virtue of previously mentioned decree of this court.
- Complts say that Thomas Sympson made over, in his lifetime, all his share of the estate of Richard Dynes to Richard Sympson
- Complts claim that Preswicke has expended £600 on this suit in this court between him and the said Atkinson
