Will of Thomas Pybus of Knayton in the County of York, Yeoman.

 Dated 31.1.1760, proved 1762 at Durham.

This is the Last will of me Thomas Pybus of Knayton in the County of York yeoman being of sound mind & memory in manner and forme following that is to say 

first of All I give and bequeath unto my daughter Jane Pybus the sume of fifty Pounds 

Also I give and bequeath unto my Daughter Catherine Pybus the sume of fifty Pounds 

also I give and bequeath unto my daughter Dorothy Pybus the sume of fifty Pounds which sd: severall Legacies so above named I hereby order shall be paid to Each of my sd: daughters within twelve months after my Decease by my Executrix hereinafter named 

And whereas my Daughter Ann Pybus married one Thomas Nicholson contrary to my Inclination and my will & mind is that some Provision be made for her and her Children Independant of her sd: husband and for that Purpose I hereby order my Executrix within Twelve months after my Decease to pay into the hands of Thomas Swan and George Kilvington or the one of them the Sume of fifty Pounds to the uses intents and purposes & subject to the trusts hereinafter mentioned that is to say to the use and intent & purpose that the sd: Thomas Swan and George Kilvington their Extors & admors shall and may During the life of my said Daughter Ann Pybus als Nicholson have the management and Putting out to interest the sd: fifty Pounds upon Trust that they the sd: Thomas Swan & George Kilvington and the survivor of them their Extors or admors of such survivor during the life of my sd: Daughter Ann pay yearly or as the same shall become due the interest of the sd: sume of fifty Pounds when and as often as they shall receive the same unto her the sd Ann & not unto the sd Thomas Nicholson the husband and that her receipt alone shall be a sufficient Discharge to them for so Doing Notwithstanding her Coverture And form and after her Decease I give and bequeath the sd: sume of fifty Pounds among her Children (which shall be then living Equally to be Divided share and share alike) by the sd: Thomas Nicholson or any after taken husband) And further in Case the sd: Thomas Nicholson or my sd: Daughter Ann his wife shall Comence any Suite or Suites in any Court of Lawe or Equity or by any means disturb my Executrix or Trustees hereinnamed or any other person or persons to whom any thing is by me given in this my will from the receiving and Quiet Enjoyeing of what is by me herein given and in such manner as aforementioned Then my will & mind is that the sd: Sume of fifty pounds by me given to the sd: Thomas Swan or George Kilvington in Trust for the wife and Children of the sd: Thomas Nicholson or any after taken husband shall Cease Determine & be Utterly void and that then and from thenceforth I do give and bequeath the sd: Sume of fifty Pounds given in Trust as aforesd among my Daughters Jane Pybus Catherine Pybus and Dorothy Pybus their Extors admors & asses share & share alike 

And all the rest and residue of my worldly goods and Effects whatsoever (after my funerall Expences and Just Debts are paid) I give and bequesth to my Loving wife Jane Pybus her Extors admors & asses and Hereby Nominate and appoint my sd: Dear wife Sole Executrix of this my Last will and Testament hereby revoking all former wills by me heretofore made And I hereby order my said Executrix to Call in such moneys as she shall think fitt to Discharge the sd: Legacies within twelve months after my Decease In witness whereof I have hereunto sett my hand & seal this 31st day of January 1760
